U.S. Virgin Islands Calls for People with Cannabis Convictions To Reach Out for Expungements

Why it matters: The U.S. Virgin Islands is working to rectify past inequities in the criminal justice system by expunging cannabis convictions. The government is urging eligible individuals to come forward and take advantage of the opportunity for a fresh start.

What they are saying: U.S. Virgin Islands Gov. Albert Bryan Jr. is calling on residents with cannabis convictions to proactively contact the government to determine if their convictions are eligible for expungement. The government has formed a task force to manage the expansion of expungement services and address any potential gaps in data received from the judicial branch. However, former Sen. Janelle Sarauw expressed disappointment in the lack of progress and stated that the intent of the legislation was to ensure a fair shot at life for those who have been disenfranchised or locked up for cannabis.

The big picture: The U.S. Virgin Islands legalized adult-use cannabis in January 2023 and aims to provide opportunities for those negatively impacted by the criminalization of cannabis to participate in the legal cannabis industry. However, there have been delays and little information provided regarding the expungement process and the allocation of funds for the program. The cannabis law allows for the possession and cultivation of cannabis for both recreational and sacramental use, as well as the implementation of taxes to fund various programs.

What to watch: It is important to monitor the progress of the U.S. Virgin Islands’ expungement initiative and the implementation of the cannabis program. Additionally, attention should be given to the allocation of funds for expungement services and the appointment of representatives to the Cannabis Advisory Board.

My take: Expunging cannabis convictions is a crucial step towards addressing historical injustices and providing individuals with a fresh start. It is disappointing to see the lack of progress and transparency in the U.S. Virgin Islands’ efforts, as voiced by former Sen. Janelle Sarauw. The government should prioritize providing updates and ensuring the efficient allocation of funds to support expungement services.
